Fisher vs. University of Texas

The United States Supreme Court just released a huge case addressing affirmative action — Fisher vs. University of Texas. The primary issue was what particular “standard of review” a court should apply when reviewing a school’s admissions policy that considers race as one of several factors. The Supreme Court ruled that the school must prove its admissions policy is “narrowly tailored” to obtain the educational benefits of diversity. The Supreme Court further clarified that “all racial classifications must be analyzed … under strict scrutiny” and lower courts must “closely examine” how the school’s admissions process works in practice. Although race can still be used as a factor for admissions, schools will now be subject to much greater scrutiny. Have a GREAT week everybody! All my best, Matt Catchick.
